Purpose. The paper considers the establishment of the paradigmatic determinants of the understanding of crime on the basis of fundamental changes in understanding of the essence of a man in ancient, medieval, Renaissance, modern and postmodern philosophy. Theoretical basis. The author determines that the understanding of the concept of crime is possible only in the combination of historical, philosophical, legal and sociological approaches. The interpretation of the essence of this concept dynamics and relevant legal practices is based on structuralist, post-structuralist (...) and hermeneutical methodological principles. Originality. The author has proved that the concept of "crime" is not a constant but a historically variable category whose dynamics of meanings is linked to a change in philosophical anthropological paradigms. Its understanding is primarily related to the interpretation of the essence of a man and the imperatives of his behavior. This allows a new understanding of the philosophical foundations of modern criminology. Conclusions. The article establishes that in the history of Western philosophy, there are five anthropological paradigms that differ in a thorough rethinking of the essence of a man. The first cosmocentric regards man as a microcosm, his soul and actions must be in harmony with the harmony of the Cosmos. The second Theocentric considers a man the image and likeness of God, though he is at the same time burdened with original sin. In the era of early Modernism, the third paradigm, which we called cognitive-centric, becomes dominant, since the essence of a man is reduced primarily to his mind. It gradually changes to the fourth – sociocentric, which focuses on the social essence of a man. However, despite its continued existence in our time, at the end of the XX century, there is a transition to the fifth paradigm – postmodernist, which deconstructs the essence of a man, reducing it to the role of an element of power systems. These paradigms, with a certain synchronicity, create the corresponding concepts of "crime": from violation of polis-space laws to identification with sin, from non-observance of mental and moral standards to social deviance. Contemporary understandings of crime are, for the most part, relativistic and constructivist, which is consistent with the postmodern anthropological paradigm. However, the diversity of interpretations of the concept of "crime" that exists in the current scientific literature needs further comprehension. (shrink)

Purpose. The purpose of the research is to define certain interaction features between a human and the urban environment in the global world. Theoretical basis. The study in based on the investigations of contemporary researchers in social philosophy and urban science, as well as social scientists of Chicago School. Originality. The originality of the research is to analyze the "human-urban space" system in terms of the influence of local space of the global world on the human identity formation and preservation. (...) Conclusions. Modern information technologies have significantly contributed into changes in the culture, society, individual consciousness and perception. They have given them absolutely global character and reorganized the value and standard system of the individual. As a result, it caused the identity crisis, so typical of the postindustrial society. This paper examines the use of tablet personal computers and how they interfere with Nigerian undergraduates reading culture and love for educational books. The study adopts a descriptive research design. The University of Ilorin undergraduates constitute the population for this study while 200 level students of three faculties across the university constitute the target population. Stratified sampling technique was used to sample the needed respondents. A researchers’ designed questionnaire was use for data collection. The collected data was analysed using descriptive (...) statistics. The findings revealed that access to tablet computer influence the undergraduate reading culture. Also, 55.7% of 200 level undergraduates read more electronic materials on their tablet computer than printed texts. Based on the findings of this study, it is recommended that students should be encouraged to visit the library and read textbooks since there is certain fundamental knowledge that might not be accessible on the net. A number of scholars in the history of medieval Iceland have emphasized the exceptional importance of law and justice for Icelandic society. According to American researcher J. Bajok, the focus of Iceland's culture was law, and the relationship between Godi and his heirs was also based on law. The nature of Iceland's socio-political institutions reveals the circumstances in which Icelanders' attitudes towards the law were shaped. The royal power in the country during the Commonwealth period did not arise, and the (...) system of chiefs or Godords became specifically the Icelandic institute of government. It is traditionally believed that the country was divided into 4 quarters, consisting of 36 Godords, headed by leaders. The year 930 is considered the date of Altinga's founding. National Assembly of Iceland. Each year, a three-year lawmaker in Altinga had to promulgate a third of the country's laws. The lawmaker selected those who were to sit on the Rock of Law and designate the place where the Courts of the Quarters, which had pending lawsuits, were to be held. The most important institution of Altinga was the Legislative Council, which dealt with legal issues. The council members were 48 leaders or heads. The representatives of the highest level of the religious hierarchy - the bishops of dioceses on the Chamber Hill and the Hills - were also members of the Legislative Council. The bishops participated in three important events for the country: the drafting and adoption of the Law of Tithes in 1096/97, the codification of secular laws in 1117 - 1118, and the record of about 1123 of the Christian Law, which was included in the Gray Law Code. The effect of task difficulty on inter-task transfer is a classic issue in motor learning. We examined the relation between self-efficacy and transfer of learning after practicing different versions of a stick balancing task. Practicing the same task or an easier version led to significant pre- to post-test transfer of learning, whereas practicing a more difficult version did not. Self-efficacy increased modestly from pre- to post-test with easy practice, but decreased significantly with difficult practice. In addition, self-efficacy immediately prior to (...) the post-test was significantly lower after difficult practice than easy or intermediate practice. Self-efficacy immediately prior to the post-test, performance at the end of practice, and pre-test performance explained 75% of the variance in post-test performance. The mediating role of self-efficacy on transfer of learning offers an alternative explanation for recent findings on the superiority of easy-to-difficult transfer and may help clarify inconsistencies in earlier research. Thomas S. Kuhn’s theory of normal science (NS), aside from being a provocative philosophical reconstruction of the relatively conservative phase of scientific research, contains useful ideas for systematic analysis of specific episodes in the history of science. Therefore, although the theory has been looked at from different angles since the first edition of The Structure of Scientific Revolutions (TSSR) was published in 1962, its detailed exploration of the cumulative phase of research in mature science is of abiding relevance in the (...) philosophy of science. This is because NS provides a compelling account of how and why members of scientific communities succeed, largely, to produce reliable knowledge about an incompletely known phenomenal world. Again, the theory elucidates special features of scientific research that differentiate it from other creative enterprises. In that regard, this paper reconstructs Arthur Compton’s research into x-ray scattering as a good instantiation of NS. Discussion of Compton’s convincing demonstration of the particulate properties of electromagnetic radiation within the framework of NS showcases the elucidatory power of Kuhn’s theory with respect to selected episodes in science, and corroborates the notion that the bulk of scientific work is a conservative puzzle-solving activity with the potential for precipitating scientific revolutions. To the best of my knowledge, this is the first time that Compton’s groundbreaking work on x-ray scattering has been analysed within the framework of Kuhn’s philosophy of science. (shrink)

This paper examines the impact of the introduction of Western (European) technical civilization on regional cultures in Nigeria, using Igboland in South-EasternNigeria as a test case. It begins with a discussion of some general features of Western technical civilization whose evolution has been profoundly influenced by technological advances in Europe and her cultural colonies in North America and elsewhere. Consequences of the contact between Western technical civilization and traditional Igbo culture are also examined. The paper addresses the use of heterogeneous ensembles of intelligent unmanned vehicles in such a perspective field of innovations as an unmanned fishery. The issues of joint activity of unmanned vehicles of different types in fishing operations based on intelligent technologies are investigated. The “smart fishing” approach based on the joint fishing operation model is proposed. The operational framework that includes missions, roles, and activity scenarios embedded in the discretized spatial model is presented. The scenario activities are considered as the (...) sequences of pentad that determine executing specific functions concerning the specified waypoint, timepoints, and the states of vehicles. The definition of the plan as the scenario prototype that needs adjusting to the conditions of the situational context is proposed. The coordination problem regarding the joint activities of the unmanned vehicles and their scenarios is defined and the coordination framework based on the distributed common board model and coordination primitives is presented. The prototype of the intelligent scenario-based system including the implementation of both operational and coordination frameworks developed for the control of unmanned vehicles is described. This system makes unmanned vehicles capable to absorb all the latest advances in intelligent technologies to perform smart fishing operations jointly in a large heterogeneous group. The proposed approach to smart fishing using intelligent technologies makes it possible to detach fishermen from the fishing activities dangerous to their life and health, to reduce significantly poaching and illegal fishing, to increase the overall efficiency of fishing operations, and even to save the marine ecosystem. Many corporations are large, powerful, and wealthy. There are massive shortfalls of global justice, with hundreds of millions of people in the world living below the threshold of extreme poverty, and billions more living not far above that threshold. Where injustice and needs shortfalls must be remediated, we often look towards agents’ capabilities to determine who ought to bear the costs of rectifying the situation. The combination of these three claims grounds what I call a ‘linkage-based’ account of why corporations (...) have demanding positive duties to the global poor. In this paper, I put forward a distinctive linkage-based account of corporations’ positive duties centred on the idea of dependence and the importance of meeting agents’ core needs. In addition to outlining and defending this account, I will show that we can utilise its basic conceptual components to make headway on questions that have received insufficient attention in the business ethics literature; specifically, we can say something substantive about the weighting of needy agents’ competing claims to assistance, and about the limits to the demands that can be lodged against corporations on the basis of others' unmet needs. Having integrated considerations of duties' grounding, their comparative weight, and the limits of their demandingness into a single account of corporate positive duty, I conclude by discussing a challenge to attributing to corporations duties owed to the worst-off amongst the global poor. Viktor D. Kudryavtsev-Platonov is one of the most prominent representatives of Russian religious-academic philosophy of the second half of the nineteenth century whose theory of cognition bears an imprint of the Kantian theoretical philosophy. Kudryavtsev was not only thoroughly familiar with the Königsberg thinker’s work, but offered a critically reinterpreted version of Kant’s teaching on space, time and categories of understanding. But was the Russian philosopher original in his reading and critique of Kant? In his later works Kudryavtsev often cites (...) the works of Friedrich Adolf Trendelenburg whose works turn out to be very close to the Russian philosopher. Could it be that Kudryavtsev read Kant through Trendelenburg’s optics? To answer this question consistently I give outlines of Trendelenburg’s and Kudryavtsev’s theories of cognition and compare their views on the basis of the sources. I then draw on archive materials to characterise Kudryavtsev’s acquaintance with the works of Kant and Trendelenburg. It turns out that Kudryavtsev was well-versed in Kant’s philosophical ideas already in the early years of his teaching activities — but not from primary sources, but largely through German historical-philosophical renderings. I establish similarities between the teachings of Trendelenburg and Kudryavtsev on space, time and the categories of understanding and their critique of the relevant Kantian teaching. Finally, Kudryavtsev’s early manuscripts attest to his acquaintance with Trendelenburg’s ideas. I conclude that Trendelenburg influenced Kudryavtsev’s own theory of cognition, a fact that should be borne in mind when reading the Russian philosopher’s epistemological works. (shrink)

Over 1000 companies have either curtailed or else completely ceased operations in Russia as a response to its invasion of Ukraine, a mass corporate exodus of a speed and scale which we’ve never seen. While corporate withdrawal appears to have considerable public support, it’s not obvious that it has done anything to hamper the Russian war effort, nor is it clear what the long-run effects of corporate withdrawal as a regularised response to war might be. Given this, it’s important the (...) evaluate the ethical merits of such a response. In this paper I critique what I take to be the two most common arguments given in favour of voluntary corporate withdrawal, which I label ‘the instrumental argument’ and ‘the clean hands argument’ respectively. After illustrating their shortcomings, I reframe corporations’ predicament as a ‘spattered hands’ case—one where they may do good by remaining in a war-waging state, but where they contribute indirectly to grave wrongdoing by doing so. Drawing on ideas from the ‘Business for Peace’ and ‘Business and Human Rights’ literature, I highlight the potentially positive role of corporate presence within war-waging countries, before highlighting four considerations which corporations ought to bear in mind when determining whether to withdraw, or whether it is the lesser evil to stay and to let their hands be spattered. In clarifying the nature of these claims, I can initially respond to some of the main points advanced by various of the helpful review essays in this symposium.Framing the Argument of the BookThe first part of the work posits that there is a fundamental developmental continuity between Old and New Testament revelation, wherein God is revealed first to Israel as the one Creator, and subsequently in Jesus Christ as three distinct persons, the eternal Father, Son, and Holy Spirit.1 This revelation is in turn received in the pre-Nicene era of the early Church, principally under a twofold conceptual format, according firstly to a model of God as a single transcendent subject of wisdom who sends his Word into the world in human nature, and inspires the prophets by his Spirit (the apologists' monotheistic model, exemplified by Justin Martyr) and, secondly, to [End Page 569] a model of economic Trinitarian activity, of the Father, Son and Spirit, who are each divine and one in being, active in sacred history (Irenaeus).2 Nicene Trinitarian authors sought in various ways to find a deeper concordance of the two approaches, one of which emphasized more the immanent unity of God (potentially tending toward a danger of Sabellianism) and the other of which emphasized real distinction of persons active in the economy (potentially tending toward the danger of subordinationism).3 Pro-Nicene figures like Athanasius, Gregory of Nazianzus, and Augustine, among others, paved the way for a mature doctrine of immanent Trinitarian life, in which God was understood to be characterized, mysteriously, by eternal processions of the Word and the Spirit who originate from the Father, and receive from him the plenitude of their deity or divine nature, and thus are equally and identically the one God.4 God is mysteriously three persons who are truly one both in essence and being.The second part of the book is concerned with the theological exploration of what it means to speak of God as one, and of the divine nature of God. This determination of Christian theological wisdom stems from a threefold exigency: first, to uncover the inner unity of revelation itself, as indeed the Israelite revelation of the divine unity and the oneness of God the transcendent Creator is thematic to both Testaments;5 second, to consider the preconditions of Nicene orthodoxy, as indeed the claim that the three persons in God are one in essence or nature presupposes that there is a nature of God that is one common to the three persons;6 third, to consider what must be said about the inner life of God as truth and love, as a precondition for thinking about the processional life of the Word and Spirit, who are immanent distinct persons in God who receive and possess this fullness of life but who do not divide this one eternal life in God or cause it to evolve due to their relational proceeding.7I argue that a consideration of God's nature as simple, perfect, good, eternal, immutable, and so forth is essential to any theology that takes the biblical revelation of the unity and transcendence of God seriously, and therefore confesses the revelation of the Trinity integrally.8 Furthermore, regarding [End Page 570] the apophatic contours of this form of reflection, I hold that it is precisely in order to guarantee the kind of circumspect avoidance of "non-biblical speculation" about positive knowledge of God outside of Christ that it is necessary to qualify rightly how God is not identifiable with creation and thus remains unknown in his inner divine nature and eternal life apart from and outside of his divine self-disclosure in the revelation of the Old and New Testaments. Even when I counter by saying, “The Church teaches that something is good because it is good and not because the Church says it is good, and such goodness is grounded in the natural law and a sound anthropology,” such legalism still persists. And so, to read Pruss’s extensive analysis of sexual ethics using both personalist and Thomistic principles as well as what we have received from divine revelation is a much-needed tonic not only for students of theology and philosophy but for all those interested in discovering the role of human reason and biology in crafting a sexual ethic.After an introduction, the proper beginning of Pruss’s analysis is found in chapter 2. Here, the author discusses love and its forms with a particular focus on the meaning of agapē in the New Testament. Pruss argues that, philosophically speaking, we should love everyone. But love should not be understood as monolithic. There are various kinds of love: agapē, philia, and erōs. The New Testament understanding of agapē contains the other two, for it is love itself. This kind of love is a love that loves the other as the other is, for the other’s sake, and in a way that is appropriate to that person in the light of objective facts. Moreover, this kind of love is not simply a feeling or an emotion but is concentrated in an action that is an expression of one’s will.In chapter 3, Pruss takes up the issue of desire. He evaluates desire in two ways: (1) desire and libido, and (2) sexual desire, need, and pleasure. He [End Page 485] concludes that sexual desire is not a need in the same way that we desire food, drink, communication, love, and to be loved. Without these latter, human life would be seriously lacking or, in the case of food and drink, quickly cut short. Second, he observes that circumstances may not be appropriate for fulfilling one’s sexual desire. Finally, while human life would be seriously compromised by the lack of food, drink, communication, love, and the need to be loved, abstaining from the fulfillment of sexual desire even over a long period of time would not be detrimental to human well-being in the same way.Pruss does not imply by the preceding that sexuality does not matter. Chapter 4, in fact, deals with the meaningfulness of sexuality. There are two sets of rules regarding sexuality and its expression. Some rules are moral in nature, like the prohibition against rape. Other rules are customs, for example, the exchanging of rings after the exchange of marital vows. With respect to the moral rules regarding sexuality, Pruss highlights casual sex, sexual assault, gay rights, and romantic love. Apart from sexual assault and rape—both of which lack consent—casual sex, homosexual sex, and romantic love have the following in common, namely, that sex is indeed innately important to human beings and that sex aspires to be romantic in nature. While, as in the case of casual sex, romantic love does not necessarily give rise to true love, romantic love is often the prelude to a deep and unique form of love. Thus Walter Kaufmann reads the quotation as showing how the Christian faith enables its adherents “to indulge their lust for revenge by hoping for the eternal torture and destruction of their persecutors.”3 Weaver Santinello echoes this sentiment when she claims that “‘the great teacher and saint [Aquinas]’ had a ‘bloodthirsty vision of Hell.’”4 Even so sensitive a Christian as Merold Westphal reads Nietzsche’s Aquinas in this way. “[I]t is hard to deny that the spirit of resentment and longing for vengeance burns hot in these passages... in them the final judgment makes the Final Solution seem almost moderate.”5 Similar comments and observations so abound in the scholarship that they form a virtual consensus on this Summa passage’s teaching.6This proliferation of such statements on Aquinas’s meaning, however, contrasts sharply with the absence of careful analyses [End Page 426] of the passage. I do not know, in fact, of a single article, book chapter, or study that takes Nietzsche’s quotation of Aquinas for its theme. More generally, despite the vast literature on Nietzsche and Christianity, comparative studies of Nietzsche and Aquinas are rare.7 The absence of substantive studies on the Genealogy’s use of the Aquinas quotation is doubly unfortunate. First, it silences or at least muffles the voice of Nietzsche. He cites Aquinas’s text in the specific context of Treatise I of the Genealogy. The quotation reveals the full meaning that Nietzsche intended it to convey only when it is read in that context. Second, it obscures and distorts the thought of Aquinas: the quotation must be read in its own context in the Summa theologiae to grasp the teaching that Aquinas intended his words to express.In light of Aquinas’s importance as a Christian theologian and the crucial role he plays in the Genealogy’s critique of moral values, I intend to examine Nietzsche’s presentation of this text. Careful study of this matter can shed light on a key question which has long been discussed and debated: Is Nietzsche’s account of Christianity as life-inimical rooted in an extraordinarily perceptive reading of the Christian psyche? Or is it based, rather, on a profound misunderstanding of that psyche? I will argue for two points: (1) that Nietzsche has utterly misconstrued Aquinas’s teaching; and (2) that Aquinas’s Christian morality, far from being life-inimical, is life-affirming. Aquinas does not here expound at any length upon the reasons why God does not share the misery of the miserable.Thankfully we are not the first students of theology to approach the writings of Aquinas. Nor are we the first to observe the prima facie oddness of a seemingly impassive God within Aquinas’s consideration of mercy. Throughout history, theologians of profound elegance and insight have sought wisdom from the Angelic Doctor. Some have even devoted their academic lives to the task of studying, expounding, and “commenting” upon the Thomistic text. In this essay, we intend to rely upon—and thereby highlight—a few of the valuable insights into divine mercy these Thomist commentators offer within their commentaries. Because the Thomist commentatorial tradition includes far too many figures to summarize in a few pages, we have decided to draw from only a small handful of the major Thomist commentators within a limited period of theological history, roughly from the sixteenth through the eighteenth centuries.4 Moreover, while the Thomist commentators exhibit a wide range of uniqueness and nuance amongst themselves, we might observe in our analysis a fundamental first principle uniting these major figures: the real distinction between act and potency (as well as between form and matter). We generally accept that medicine’s conceptual and ethical foundations are grounded in recognition of personhood. With patients in vegetative state, however, we’ve understood that the ethical implications of phenomenal consciousness are distinct from those of personhood. This suggests a need to reconsider medicine’s foundations. What is the role for recognition of consciousness (rather than personhood) in grounding the moral value of medicine and the specific demands of clinical ethics? I suggest that, according to holism, the moral value of medicine is (...) secured when conscious states are recognized in everyday medical science. Moreover, consciousness fully motivates traditional principles of clinical ethics if we understand respect for autonomy as respect for the dominion of an experiencer in the private, inescapable realm of bodily experience. When medicine’s foundations are grounded in recognition of consciousness, we understand how patients fully command respect even when they lack capacity to exercise their bodily dominion through decision-making. Directed panspermia is the deliberate seeding of lifeless planets with microbes, in the hopes that, over evolutionary timescales, they will give rise to a complex self-sustaining biosphere on the target planet. Due to the immense distances and timescales involved, human beings are unlikely ever to see the fruits of their labours. Such missions must therefore be justified by appeal to values independent of human wellbeing. In this paper I investigate the values that a directed panspermia mission might promote. Paying special (...) attention to the outcome in which sentient animals evolve, I argue that we have strong reasons to believe the value of a mission would be negative. Research on wild animal suffering has shown that there is a huge amount of suffering among wild animals on Earth. I argue that there are structural features of evolution by natural selection which explain the prevalence of suffering on Earth, and make it predictable that suffering would prevail on the target planet too. Finally, using insights from procreative ethics I argue on non-consequentialist grounds that creators have duties to their sentient creations which cannot be met in directed panspermia missions. I examine error diagnosis (model-model disagreement) in climate model intercomparisons including its difficulties, fruitful examples, and prospects for streamlining error diagnosis. I suggest that features of climate model intercomparisons pose a more significant challenge for error diagnosis than do features of individual model construction and complexity. Such features of intercomparisons include, e.g., the number of models involved, how models from different institutions interrelate, and what scientists know about each model. By considering numerous examples in the climate modeling literature, I distill (...) general strategies (e.g., employing physical reasoning and using dimension reduction techniques) used to diagnose model error. Based on these examples, I argue that an error repertoire could be beneficial for improving error diagnosis in climate modeling, although constructing one faces several difficulties. Finally, I suggest that the practice of error diagnosis demonstrates that scientists have a tacit-yet-working understanding of their models which has been under-appreciated by some philosophers. ABSTRACT This paper argues that the retort ‘easy for you to say’ is a complaint about the target’s standing, but that it invokes a standing norm that is unjustified. Moreover, I argue that in many cases the person for whom it is ‘easy to say’ should speak.

In this paper I am going to argue that we should take actions to be prime. This will involve clarifying what it means to claim that actions are prime. I will consider Williamson's construal of actions as prime in a way that parallels his treatment of knowledge. I will argue that we need to be careful about treating our actions in the way suggested because of an internal relation between the success condition of an action and the action itself; a (...) parallel relation does not hold for most cases of knowledge. ABSTRACT Einar Bohn [AJP 2019] has proposed a version of panpsychism on which consciousness is fundamentally a property of pluralities of basic objects. I argue that this pluralized panpsychism is structurally similar to emergentism, and faces the problem of explaining how a plurality of basic objects could be a subject of experiences. Because of these issues, pluralized panpsychism is not a substantial improvement on orthodox panpsychism.

This paper presents a longue durée account of the discursive emergence of ‘the market'. It seeks to develop understanding of the ‘crisis system' by showing that the crises of the present have their origins earlier than some critical realist scholars have suggested and can be better understood by the theorization of the generative mechanisms that emerged from the economic and political chaos of the early 1600s. Critical discourse analysis (CDA) is employed to show that in the context of the emergence (...) of capitalism in England, these generative mechanisms resulted in the meaning of the word ‘market’ slipping loose of the geo-spatial semiotic bounds by which it had commonly been delineated – i.e. as a physical space in a town or city where goods were bartered or sold – and being re-semioticised to refer to abstract space where all acts of capitalist economic exchange, including those impacting upon the natural world, take place.
